My View - on Masipa's Judgement
Reasonably, Possibly True?
We have heard this so often from the legal experts - one of the tests- REASONABLY POSSIBLY TRUE!
I suspect that not many believed Pistorius would be found guilty of pre-meditated murder. I certainly didn't!
Of murder? The numbers believing he would be found guilty on this charge would increase dramatically without doubt.
I hoped that he would!
Culpable Homicide - Always the 'last resort' I would imagine for most. But still if found guilty on this charge most I would imagine would hope that Pistorius receive a custodial sentence.
I did from early ask if found guilty of such a charge was there any such thing as a suspended sentence or similar in S. Africa, as something niggled me in this regard, the possibility that Pistorius would get off lightly!
Seems there is!
Of course Judge Masipa has yet to make known her judgement on this count, and any sentence she will decide we will not know of until some time later. But increasingly listening to the legal experts, it is looking very unlikely that Oscar Pistorius will spend any time behind bars for killing in cold blood, Miss Reeva Steenkamp.
I hope that will not be the case. This man Pistorius, in my view, knew exactly what he was doing who was behind that toilet door.
And as Gerrie Nel stated - no matter who was behind that door - Pistorius intended to shoot, injure and most probably kill that person.
Why would that NOT be his intention, if he, Pistorius told the Court that he feared for his life and that of Miss Steenkamp?
In such circumstances, such fear, are we to believe Pistorius intended with a loaded gun containing black talon bullets, ONLY to 'nick' the intruder, inflict a little flesh wound?
Come on Masipa - You KNOW that is not the case at all.
Masipa acknowledges that Pistorius has lied and lied and cheated and was evasive. She said this does not necessarily mean he is guilty. Of course it doesn't!
But when we look at the nature of the crime, and apply and attach those LIES to the circumstances...?
Come on Masipa!
Around the world people have asked from the beginning of this trial:
HOW IS IT POSSIBLE THAT PISTORIUS RAN FROM THE BEDROOM AREA TO THE BATHROOM AREA SHOUTING AND SCREAMING (as he testified in Court) SHOUTING TO THE INTRUDER TO GET OUT OF HIS HOME AND FOR MISS STEENKAMP TO PHONE THE POLICE AND MISS STEENKAMP DID NOT HEAR THIS?
Come on Masipa get a grip. NOT REASONABLY POSSIBLY TRUE!
That there were two persons HARD OF HEARING? in the Pistorius home that evening - Miss Steenkamp and this alleged intruder -
JUST NOT REASONABLY POSSIBLY TRUE!
NEIGHBOURS HEARD SCREAMS - the sounds travelled - yet we are to believe that Miss Steenkamp heard NOTHING WHEN PISTORIUS SHOUTED TO THE INTRUDER AND SHOUTED TO HER TO CALL THE POLICE?
Please read Part 4 & Part 5 (blogs above) part of Masipa's Judgement, and I am sure to most it will make little sense as to how she then reached her decision based on what is stated therein how she was able to determine that Pistorius was not guilty of murder!
It is pretty astonishing.
Masipa of course has still to continue with her Judgement today with regards Culpable Homicide, any sentence, so not to be too hasty...
Do I really think Pistorius will receive a custodial sentence if found guilty of culpable homicide?
Not in a month of Sunday's, that is, not based on what the legal experts have been telling us.
But perhaps Masipa will come through for Miss Steenkamp, for justice for her young life being so cruelly taken. Justice for the Steenkamp family.
But then again, when I read Masipa's Judgement - that all that Pistorius said regarding these points must 'UNFORTUNATELY be TREATED AS CONJECTURE?
Then what hope is there that justice will be served for Miss Reeva Steenkamp and her family?
There is much talk about the findings on the charge of murder by Judge Masipa, already talk among legal experts of the possibility of the State lodging an appeal to the Supreme Court.
I guess whether that happens will much depend on the final part of Judge Masipa's verdict today.
Let us see.
